
Plea against Sion hospital dismissed
The Bombay High Court recently dismissed a writ petition filed against Lion Tarachand Bapa hospital at Sion by a local resident. Chief Justice M B Shah and Justice Y S Jahagirdar upheld the notification dated November 8, 1985, issued by the state government under the Maharashtra Regional Town Planning Act, which changed the reservation of the plot from 8220;existing recreation ground8221; to combined use of 8220;existing recreation ground and existing medical facility-cum-diagnostic centre.8221;
The petitioner, Poonamchand Ratilal Doshi, a resident of Ramkunj Apartments near the hospital, had alleged that the construction of additional floors on the old building and its expansion would deprive the residents of the recreation ground for which the plot was earlier reserved. The high court heard the petitioner8217;s counsel on merits and concluded that it 8220;was not necessary to entertain this petition as a public interest litigation seeking to set back the clock.8221;

The Bombay High Court today ordered for immediate removal of the president of the Maharashtra Co-operative Appellate Court T A Hade. The division bench of Chief Justice M B Shah and Justice S Radhakrishnan ruled that Hade should stop functioning since he was found ineligible for the post. His appointment in 1996 was not in accordance with the rule book, they said. Similarly, the bench ruled that appointments of three of the total five members, who were continued after the age of superannuation, be considered as per the new recruitment rules. Earlier, the HC had ordered that civil judges to man the co-operative courts following severe inconvenience caused to litigants due to closure of eight co-operative courts in the state. Since the appointment of civil judges was a stop-gap arrangement, the HC has now directed the Maharashtra Public Service Commission and the state government to fill the eight posts by the end of December.
Vasai traders on hunger strike
The relayhunger strike by small scale industrialists and traders of Vasai entered its fifth day today. The strike are seeking removal of the private contractor appointed by the Navghar-Manikpur Municipal Council to collect octroi duty. The traders alleged extortionist methods adopted by the contractor. 8220;We cannot bear the harassment and delaying of goods for monetary gains which has been on the rise,8221; said Anil Ambardekar, Vasai Industries8217; Association secretary.
