
BHUBANESWAR, Nov 24: Two suspended Parliament members of the Biju Janata Dal BJD, Tathagat Satpathy and Prabhat Samantray, have withdrawn the suit filed by them in the court of the senior civil judge, Basudev Tripathy, here challenging the suspension order served on them by party President Naveen Patnaik.
Senior advocate Sarat Gajendra filed the petition on behalf of the MPs, praying that the suit filed by them be withdrawn, in view of the fact that the suspension order and the plea to declare them 8220;unattached8221; have been rejected by Lok Sabha Speaker G M C Balayogi.
Gajendra said that in view of the direction of the Speaker, his clients do not want to pursue the case further. However, the advocate for the MPs prayed for permission from the court to refile the case later, if necessary. After hearing the counsels of both sides, the senior civil judge on Monday permitted withdrawal of the case.
The two MPs and five expelled MLAs of the BJD Prabhat Tripathy, Surya Narayan Patra, Bishnu Das, KalpataruDas and Bijoyshree Routray had filed separate suits in the court, challenging the order of Patnaik. They had also filed two separate petitions praying for issuance of mandatory injunction against Patnaik, directing him not to give effect to the orders till the cases were disposed of.
After hearing both the sides on Saturday, the judge had reserved his order on the interim injunction for December 1.
