63-yr-old trader sentenced to 1-yr RI in porn CD case

A prominent businessman of Shimla, involved in the infamous porn CD scandal of 2004, was today sentenced to one-year rigorous imprisonment by a fast-track court in Shimla.

While giving the orders in the case, the court observed that the accused, Vijay Kumar Sood, was a married man of 63 years with four children and keeping in view his age, character and nature of offence, he was sentenced for one year under the Indecent Representation of Women (Prohibition) Act, 1986. He was declared guilty of character assassination of a woman under the Act.

Judge Rajan Gupta observed that there is no denial of the fact that the victim was unmarried and the odious act had certainly ruined her life, for which the accused has been directed to pay a compensation of Rs 1 lakh to the victim.

The court said that the reputation and prestige of the victim must also have been lowered in the eyes of those who watched the obscene CD featuring her.

The accused was, however, not found guilty of charges imposed on him under Section 376 by the victim.

The victim, who was unmarried at that time, had pleaded through the Deputy District Attorney, Ajmer Singh, that she was a family friend of the accused. The accusations against Vijay Kumar Sood were that he had raped her and made a CD of the act, which was then circulated in the market. The act of making a porn CD had violated the Information and Technology Act and had hurt the feelings of women.
