JAIPUR, NOVEMBER 16: Rajasthan Governor Anshuman Singh has ordered compulsory retirement of 26 judicial officers while dismissing one magistrate from service and demoting another following a recommendation to this effect by the state high court.
The HC order was based on a review of the service records of the officers at a two-day full court meeting here on November 8 and 9. Chief Justice A R Lakshmanan chaired the meeting. The full court decided to retire 17 tainted officers belonging to the higher judicial service and nine from the lower judicial service.
The bench also resolved to dismiss judicial magistrate Bharat Lal Meena and demoted Upper Judicial Magistrate Raj Kamal Gaur to the post of judicial magistrate.
The action against judicial officers, according to high court sources, wastaken under rule number 244(2) of the Rajasthan Higher Judicial Service andrule number 53(1) of the Rajasthan Civil Service Pension Act of 1996. Thesources said the full court went into allegations against the officersas well as the evidence. It also examined their annual reports. Apart from corruption, what weighed with the court were the allegations relating to conduct, character and inefficiency.
The judicial service officers retire at the age of 60 but this is subjectto a high court decision to extend their service for two years after 58.This extension is granted by the high court after a review of the servicerecords.
Those who have been compulsorily retired include five district and sessionsjudges, 12 additional district and sessions judges, five chief judicialmagistrates and additional chief judicial magistrates and four judicialmagistrates. The five officers of the rank of a district and sessions judgeare Special Judge (family court) at Jodhpur Om Prakash Sharma (51), SpecialJudge (anti-corruption cases) at Udaipur Kusum Bhandari (53), Labour Judgeat Bharatpur PC Jain (55), Labour Judge at Ajmer BD Gupta (56) and LabourJudge at Ganganagar Narain Lal Verma (54).
The 12 officers of the rank of additional district and sessions judge(ADJ) are ADJ Phalodi CP Nahar (54), ADJ Jaipur City (Six) NP Upadhyay, ADJHindaun Abdul Hafiz Khan (56), ADJ Bundi SD Gupta (56), ADJ Chhabra JPChhangani (55), ADJ (One) SL Gupta (56), ADJ Ganganagar (One) BM Solera(52), ADJ Dholpur SS Sharma (53), ADJ Aklera BL Bundel (52), SpecialJudge SC/ST cases at Baran BK Agrawal (52) and Special Judge SC/ST cases BM Chauhan. SK Jain (52), another officer of the higher judicial service inthe same rank, who was already under suspension, was also compulsorilyretired.
The chief judicial magistrates and additional chief judicial magistratesgiven compulsory retirement are KD Gaur (56) of Bayana, BS Shekhawat (51)of Jaipur City (eight), Tek Chand (51) of Aklera, Kishore Kumar Vijay (54)of Shahabad, Shyam Lal Meena (53) of Nainwa, PD Berwa (55) of Kotda, LRLotan (51) of Aspur, KR Jatav (52) of Ghatol and Sukh Ram Jatav (52) ofIndergarh.
