Power major NTPC today claimed that the outcome of RIL-RNRL case,in which Supreme Courts verdict is awaited,will not affect NTPCs suit against RIL.
During a hearing at the Bombay High Court today,NTPCs counsel D Madon also said that gas allocation policy of the central government would not affect RIL-NTPC case.
NTPC has filed a suit against Mukesh Ambani-led Reliance Industries Limited (RIL) for performance of gas supply contract,whereby RIL was supposed to supply gas to NTPC.
While NTPC says that the contract has been concluded,RIL contends that it is yet to be finalised. Further,in the latest argument,RIL has said that governments gas allocation policy frustrates the contract with NTPC.
Today,when Justice Anoop Mohta asked whether the gas allocation policy would affect the RIL-NTPC contract,advocate Madon said it would not.
RIL has now sought certain documents from the NTPC,pertaining to the negotiations between the two parties when the contract was being negotiated.
Advocate Madon said that RIL was trying to delay the trial by moving this new application. RILs counsel,advocate Milind Sathe,countered by saying that if these documents were made available,trial wont be necessary.
Court has now given NTPC two weeks to file reply to RILs demand,adjourning the hearing till March 8.
