The Supreme Court on Friday fixed March 26 to begin the final hearing on a petition by a law intern, seeking inquiry into alleged sexual harassment charges against its retired judge Swatanter Kumar, besides examining the feasibility of having a permanent mechanism to deal with such accusations against sitting and retired judges.
A Bench of Chief Justice P Sathasivam and Justice Ranjan Gogoi observed the matter would require to be heard by a three-judge Bench and hence an appropriate Bench would be constituted.
The Court agreed to hear on the next date two intervening pleas filed in the case.
On Thursday, in his counter affidavit, Justice Kumar termed the former law intern’s sexual harassment allegations against him as “malicious,” “false” and a “result of a planned conspiracy.”
Currently heading the National Green Tribunal, Kumar sought disposal of the writ petition, while also raising objections over its maintainability.
The affidavit pointed out that Kumar had already filed a civil suit in the Delhi High Court wherein the intern was also made a party, and hence “the allegations made in the present petition are already sub judice”. He also noted that the SC in its full court resolution of December 5, 2013 held that no complaint can be entertained by the SC against its retired judges .
