Larger Bench to hear plea against Swatanter Kumar

On Thursday, in his counter affidavit, Justice Kumar termed the former law intern’s sexual harassment allegations against him as “malicious,” “false” and a “result of a planned conspiracy.”

Currently heading the National Green Tribunal, Kumar sought disposal of the writ petition, while also raising objections over its maintainability.
The affidavit pointed out that Kumar had already filed a civil suit in the Delhi High Court wherein the intern was also made a party, and hence “the allegations made in the present petition are already sub judice”.  He also noted that the SC  in its full court resolution of December 5, 2013 held that no complaint can be entertained by the SC against its retired judges .
