The Punjab and Haryana High Court has issued notices to Haryana government and M/s DLF Universal on PIL alleging nexus between the state and the giant builder.
The petitioner,Faridabad resident Archna Gupta,has accused the government of acting at the behest of the builder and subsequently transferring acquired land to it. Done under the garb of public purpose,the petitioner has alleged,the government initiated acquisition proceedings in Gurgaons Shahpur village after the builder failed to purchase the land of the petitioner and other landowners in the vicinity.
On Wednesday,petitioners counsel Shailendra Jain told the court that the layout plan shows that the location of petitioners land is such that it could only be beneficially developed and utilised for DLF Qutub Enclave,Gurgaon Phase-II,either by DLF Universal or other landowners.
The petitioner has also alleged that owing to location of her land,she was asked to sell her land to the builder. When she refused,the builder allegedly exerted political pressure and got the said land acquired compulsorily.
The Haryana government had issued a notification to acquire the land for public purpose in 2003.
The petitioner added that five plots adjoining her land,belonging to the builder,were released from the final acquisition. On the other hand,despite filing objections,her request was turned down by the government authorities. She further said that when the matter was referred to a high-powered committee by the Haryana government,the committee refused to entertain the case on whimsical and arbitrary grounds.
Jain also challenged the policy drafted by Haryana government by which it acquires sandwiched pockets and unextended standalone areas. Such a policy on the very face of it,shall be contrary to the very existence of the public purpose. Before subjecting a land under acquisition,there is already an escape route to withdraw the same from the purview of the said acquisition, he added.
