DCs were executive minions who could not transcend govt’s interest: Cong to HC

Appearing on behalf of the Congress,senior lawyer Anupam Gupta said: “If instead of independent body like the delimitation commission,DCs were allowed to conduct delimitation of Parliamentary and Assembly constituencies at the national level,then India would turn into a banana Republic.”

Gupta said so during the hearing of a petition filed by the Congress challenging the alleged fraudulent process of delimitation of wards for the upcoming gram panchayat elections in the state. The court,on the last date of hearing,had directed the Punjab government not to come up with the final notification for panchayat elections till further orders.

Gupta told the court that tinkering with the Constitution,as was allegedly done by the government,“verges precariously on unconstitutionality”. “Delimitation of wards done is nothing but an illusionary,non-existent exercise and a farce,” he added.

The counsel reiterated that Punjab has committed perjury with the court and demanded that severe strictures be passed against the authorities. “It is a case of non information. Voters have been deprived of their right to know,resulting in depriving them of their right to vote,” he said.

While justifying why it did not mention house numbers in delimitation of wards,Punjab had maintained that houses in villages do not have house numbers. Referring to the government’s justification,Gupta said: “Primordial assumptions about villages need to be discarded.”

Adjourning the case for Thursday,the division bench orally suggested to the Punjab law officer that he may seek instructions as to whether the government is inclined to invite fresh objections for its process of delimitation of wards.
