The Rajasthan High Court ordered an inquiry into the ‘illegal’ revaluation ordered by the state Medical and Health Sciences University,of the answersheets of certain candidates of MBBS course of the 2008-09 batch.
The IG police has been asked by the court to make a probe into the matter and file a compliance report within a period of two months.
Justice M N Bhandari passed this order on a petition filed by seven students of the course in 2009-10,who were denied revaluation of the answersheets of their due papers in the said course.
It was given out by the petitioners that certain candidates of MBBS course of year 2008 were allowed revaluation of their due papers as a special chance whereas there was no such provision in the University Act and revaluation rules.
The petitioner students were claiming parity and requested the court to direct the university to conduct a special revaluation of the answersheets of due paper examination of year 2010.
The university in its reply before the court argued that the order of granting a special chance was against the rules as there exists no such provision and hence no “illegality” should be allowed to perpetuate.
Taking a strong note of the stand taken by the university the court observed,”Undoubtedly the illegality cannot be allowed to be perpetuated but it is to be equally seen that no illegality is committed and when done,the same need
investigation”.
“The court however,denied to pass any order favoring petitioners against the rules for conducting special reservation.
Justice Bhandari in his order had asked IG police to investigate as to how many candidates applied for revaluation in the due papers of MBBS 2009 examination and further to name those students who passed the examination after increase in the marks in due to special revaluation.
The court also asked the police to find out as to how many of these candidates in whose case revaluation was permitted were wards of top bureaucrats,politicians and serving government doctors.
The court was of the prima-facie view that the special chance was granted illegally by the university to favour certain students of belonging to the influential families and the entire results need to be scrutinized,observed court.
