Bade Miyan Chote Miyan row: Mumbai court directs police to file FIR against director Ali Abbas Zafar for conspiracy, cheating

A Mumbai Court has directed the Bandra police to file an FIR against filmmaker Ali Abbas Zafar and his partners, on the basis of a complaint filed by producers Vashu Bhagnani and his son, Jackky. The Bhagnanis have accused Zafar and his team of fraud, forgery, criminal breach of trust, cheating and misappropriating crores of rupees by falsifying and forging signatures during the production of their film Bade Miyan Chote Miyan. Starring Akshay Kumar and Tiger Shroff, the film emerged as one of the biggest box office bombs of the year, and prompted several crew members to complain about unpaid dues.

The Bandra metropolitan magistrate court has directed Bandra Police Station to file an FIR against the film’s director Zafar, co-producer Himanshu Mehra and others under Sections 120-B Criminal Conspiracy, 406, 420 Cheating, 465 Forgery, 468 Forgery For the Purpose of Cheating, 471, 500 Criminal Defamation and 506 Criminal Intimidation, r/w.34 of the Bharatiya Nagarik Suraksha Sanhita /IPC.

The court “held that the total amount of alleged fraud and cheating and number of transactions in the several transactions is very high and they are spread across several places,” and that “the evidence needs to be collected involves several agencies and might be several number of Documents and the offences are cognizable and non-bailable and allegations are serious.”

According to the court order, the Bhagnanis have accused Zafar of not being transparent about the production costs, and sidelining representatives sent to oversee the expenses. Additionally, they’ve accused the filmmaker of exceeding the agreed upon budget by crores. The VFX budget for the film, according to the complaint, was set at Rs 18 crore, but it ended up ballooning to Rs 42 crore. The minimum production cost of the film, on the other hand, was fixed at Rs 125 crore. The Bhagnanis also accused Zafar and his partners of operating with the “intention to cheat and defraud to applicant and cause illegal gain to themselves, respondents directly approached vendors, crew, cast, etc. and finalized figures without consultation with applicant and kept spending without consent of applicant.”

Bade Miyan Chote Miyan also starred Alaya F, Sonakshi Sinha, and Prithviraj Sukumaran. The film made under Rs 100 crore worldwide.
