Bombay High Court (File) Paving the way for the development of ‘Bhidewada’ as a national monument, where the first girls school was started by social reformers Mahatma Jyotiba Phule and Savitribai Phule, the Bombay High Court on Monday dismissed a 12-year-old petition that challenged the Pune Municipal Corporation’s (PMC) decision for a national monument at Bhidewada in Budhwar Peth and urged the administration to go ahead with the land acquisition for the project.
“The PMC had passed a resolution in general body in 2006 to develop a memorial at Bhidewada where Mahatma Jyotiba Phule and Savitribai Phule had started the first girls school of the country. However, the property owned by a local bank was rented for residential, commercial and shops.
The PMC wanted to acquire the property but a few tenants objected to it and challenged the civic body resolution in 2010. There were 80 hearings in last 12 years in the case and now the high court has given the decision in favour of PMC urging it to acquire the land and build the memorial,” said PMC legal department head Nisha Chavan.
She said the HC stated that the monument is for public purpose and urged the authorities to begin the land acquisition process so that the project can be implemented. However, the HC bench of Justice G S Patel and Justice Kamal Khata stated that the petitioner can challenge the order in the Supreme Court if they want, Chavan said.
Municipal Commissioner Vikram Kumar said the civic administration would not waste any time in acquiring the land and speedily complete it. “The memorial was long pending and now it can be built as planned,” he said.
Chief Minister Eknath Shinde and Deputy Chief Minister Ajit Pawar welcomed the HC decision.
