The Bar Council of Maharashtra and Goa has passed a resolution listing various measures to check cases of fake lawyers in the state. The measures include scrutiny of documents submitted by lawyers who apply for sanad (practicing certificate) and making it mandatory for every lawyer to mention sanad number on his/her vakalatnama. The measures are expected to be introduced when the courts reopen after Diwali vacation in November.
According to senior lawyer Harshad Nimbalkar who is a member of Bar Council of Maharashtra and Goa,the issue of fake lawyers was kept on agenda after five incidents where alleged fake lawyers were arrested for representing clients in the court.
“It was decided to enforce strict measures for scrutiny of documents submitted by fresh lawyers along with strict punishment for those who are proved to be fake lawyers,” he said.
Pune District and Sessions judge Anant Badar had issued directives to all the magistrate,civil,criminal and taluka courts to make its mandatory for advocates to mention their sanad number on vakalatnama,which can be cross-checked with the Bar Council,if needed. The Bar Council plans to take cue from Pune and make it a mandatory practise all over the state.
The Bar Council of Maharashtra and Goa and the Pune Bar Association have jointly received as many as 35 complaints against suspected fake lawyers,which the council and the association are trying to verify.
According to member of privilege committee of the state Bar Council Milind Pawar,to get the sanad,an advocate has to submit their law certificate and a form with signatures of two lawyers who have over 10 years of experience. “There is no foolproof system for issuing and scrutinising sanad,” he said.
