Fourteen years after Mosha Sudhakar Tarte (25) died because of medical negligence of two KEM doctors,the court of Judicial Magistrate First Class (JMFC) S V Sahare on Friday sentenced the two doctors to one month rigorous imprisonment and Rs 2,000 fine each. The two doctors are Robin Nirdhe Majumdar of KEM doctors’ quarters and Suhas Raghubir Otiv of Kasba Peth,while the third accused Dr Namita Krishna Bhatt,continues to be absconding.

Tarte,who had a son and a daughter,had undergone family planning and quration operation at KEM on January 20,1997,and expired nine days later because of post-operative complications. Her parents had lodged complaint with the police.

According to assistant public prosecutor Rajashree Kadam,Tarte was admitted to the hospital on January 19 in 1997 and was operated the next day by the three accused. She was discharged from hospital on January 23. However,the next day,she had started vomiting and had loose motions following which she was again admitted to the hospital on January 25. Her condition worsened in the hospital after which she died on January 29.

After the complaint,Tarte’s post mortem was conducted and viscera was preserved. A seven-member expert committee formed to look into the matter confirmed doctors’ negligence behind Tarte’s death. “It was established that Tarte had developed complications as she was not given antibiotics before,during and after the surgery,” Kadam said.

Kadam was not happy with the conviction.
