SPP appointment: Court grants interim protection to Jagtap in cheating case

A sessions court granted interim protection to lawyer Shekhar Jagtap till March 14 in connection with a cheating case filed over his appointment as a special public prosecutor (SPP) during the previous government’s rule.
The investigating officer submitted before the court that the statements of parties concerned, including ministers, are yet to be recorded.
A complaint was filed claiming that there are no records available, as sought by Right to Information Act, appointing Jagtap as SPP in various cases. Jagtap has denied the charges.
His lawyer Raja Thakare told the court that Jagtap has been a practising lawyer for 23 years and has appeared for various agencies. The prosecutor told the court that it will be probing the appointment letters and other documents related to Jagtap’s appointment as SPP.
Lawyer Rizwan Merchant appearing for the complainant Sanjay Punamiya, who was named as accused in some of the cases where Jagtap was the SPP, opposed the plea stating that there are no records of his appointment.
Last week, the court granted interim relief to the joint secretary, law and judiciary, government of Maharashtra, Kishore Bhalerao, who is also named as an accused. He said that the appointment was at the time of the Covid-19 pandemic and there was a letter to prove that it was done on orders of the home department.
