Increase quota above 50% on lines of Bihar to accommodate Marathas: JD (U) MLC tells Eknath Shinde
kapil Patil said the Constitution has nowhere added the cap of 50% on reservation but it is by the Supreme Court. “The same Supreme Court has accepted reservation for economically weaker section which is going beyond 50%,” said Patil.

Maharashtra can learn from the example of Bihar which has provided quantifiable and empirical data as mandated by the Supreme Court which will pave the way to provide 18% more reservation under the OBC category to accommodate agitating Marathas, said Kapil Patil, lone legislator of the Janata Dal (United) in Maharashtra.
“Out of 346 OBC castes, Kunbi category at 83 number includes Leva Patidar, Leva Patil, Leva Kunbi, Maratha Kunbi and Kunbi Maratha. Any candidate with Kunbi certificate can avail reservation under this. It is possible to create a new group within the OBCs to expand this for which we need to increase the quota above 50% on the lines of Bihar.
It is possible to increase the quota by 18% more,” said Patil in his letter to Chief Minister Eknath Shinde.
Patil said the Constitution has nowhere added the cap of 50% on reservation but it is by the Supreme Court. “The same Supreme Court has accepted reservation for economically weaker section which is going beyond 50%,” said Patil.
Giving the example of caste survey undertaken by Bihar government led by Chief Minister Nitish Kumar, Patil said the expansion of reservation will pass the triple test as it has made available the quantifiable and empirical data. “While Bihar government did this despite none of the caste groups demanding the same, the Maharashtra government has failed to do so till now,” he said.
