A Pakistani national with a criminal record is living in the city with police turning a blind eye,claims a petition filed in Bombay High Court.
More shockingly,the petition filed by Dargah Hazrat Khwaja Mansurul,a shrine in Bhandup,alleges Sayyed Waseem-ur-Rehman Shah moves around in a red-beaconed car.
Concerned,a Division Bench headed by Justice A S Oka has asked the state government to probe the matter. It has directed police to respond to the allegations.
How can you let this man,who has offences registered against him,roam freely in the city? the bench said,observing that police routinely checked vehicles of even high court judges.
The dargah has alleged that Shah is trying to grab its land,though his role is limited to that of a spiritual guide.
Its counsel told the court Shah made inflammatory speeches and following a private complaint,the magistrate court asked police to register an FIR against him.
He claimed there were offences registered against Shah in Sangli and Mumbai as well,still he was roaming about freely in a car with a red beacon and submitted photos of the vehicle.
The court asked the municipal corporation to check if Shah had carried out illegal construction on dargah land and file a report,before adjouring the case till till November 2.
At the last hearing,the court had noted that Shah was deported on May 19,2007 but may have re-entered India illegally and asked the state and the Centre to file affidavits.
Rajendra Mandhare,inspector,CID,said in an affidavit that Shah came to India in November 2006 on a 90-day visitor visa issued by the Indian high commission in Islamabad. The visa was extended a few times until it expired in May 2007 and Shah left India May 19.
Mandhare said Shah came back on a one-month X (entry) visa in October 2010. The visa was valid till December after extensions,he said.
