Mumbai: Court rejects discharge pleas of docs booked for prescribing ‘miracle drug’ of Munir Khan

OBSERVING THAT doctors were duty-bound to give the right diagnosis, a special court rejected the discharge applications of doctors booked for prescribing medicine advertised as a “miracle drug” by self-proclaimed “miracle doctor” Munir Khan.
Khan had faced criminal charges based on several complaints against him for advertising and prescribing a medicine named “body revival” as a sure shot cure for a host of ailments including cancer and diabetes in 2009.
The Versova police had received complaints that the drug had an adverse effect on their health.
Recently, some of the co-accused of Khan sought discharge from the case, which is still pending. These included the manager and five doctors employed by Khan. They claimed that they were influenced by Khan that the medicine can cure all diseases.
These were homeopathy and ayurvedic doctors by training. The police had opposed the discharge pleas stating that Khan had prima facie used to nomenclature “doctor” despite not having a medical degree and had advertised the medicines and also hired the other doctors to prescribe the medicine.
“Patients generally approach doctors based on reputation and their expectations are that they will provide medical treatment with all knowledge and secondly that doctors will not do any harm to them because of their negligence …In this matter, the doctors without verifying about the claim made by accused no 1. (Khan) prescribed the medicine Body Revival,” special judge A C Daga said in the order passed on March 10, made available on Monday.
The court said that the conduct of the accused doctors showed that they were not only reckless but were intending to cheat the patients.
The court also in a separate order rejected the discharge plea of Khan’s son, Sarosh, stating that a forged certificates were produced to aid their crime, including letters by political leaders to promote Khan’s name for a Padmashri award.
Following the police probe, the Enforcement Directorate (ED) too had filed a case against Khan. The trial is yet to begin.
