Molestation case: HC notice to Siddharth College V-P

Inamdar has been asked to respond to the notice in four weeks.

Bombay High Court on Wednesday issued a notice to Ashok Inamdar,vice president of Siddharth College,in a revision application filed by the state against Inamdar’s discharge in a case of molestation and sections of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act,1989 filed by a professor at the college.

Inamdar has been asked to respond to the notice in four weeks.

Justice S C Dharmadhikari,however,said no offence under the Act concerned had been disclosed and notice has been issued to Inamdar only to reconsider his discharge from IPC section 354 that pertains to outraging a woman’s modesty.

The state government appeal says the sessions court that discharged Inamdar on July 24,2012 had erred in concluding that no offence was disclosed against Inamdar and that no charge can be framed against him.

Additional public prosecutor Geeta Mulekar read out the statement of a witness who had told the police that Inamdar and the woman had a scuffle in a classroom and he had misbehaved with her in her cabin.

One of the reasons for granting him discharge,the state government argued,was the delay in filing the complaint. However,Mulekar said the woman did not immediately report the incident because her reputation was at stake. She filed a complaint at Azad Maidan police station in January 2005.

In a separate case,the woman had accused Inamdar of shielding IPS officer K L Bishnoi who allegedly cleared a law examination in spite of remaining absent for a practical examination on March 12,2005. She alleged that he colluded with Inamdar.

In February last year,Bombay High Court had rapped the Mumbai Police for sitting on a complaint against Bishnoi for two years. The court had ordered a probe into the role of six serving IPS officers and one retired officer accused of “shielding” their colleague who reportedly cleared a law examination through “unfair means” in March 2005.

The revision application filed by the professor says though she was a victim of sexual harassment by Inamdar,the sessions court had discharged him in the case without hearing her.
