MCA bans Shetty for 5 yrs

THE Mumbai Cricket Association banned former vice-president Ratnakar Shetty for five years,post his allegations that their office-bearers were involved in black marketing of tickets in a T20 game between India vs Pakistan in Ahmedabad. In the letter,accessed by Newsline,MCA has called Shetty’s comments baseless and imposed a harsh penalty on their former colleague who dared to ask questions.

It was unanimously decided in the managing committee meeting held on 14th May,2013,to give you an opportunity to hear the audio recording of the proceedings of AGM held on 22nd March,2013. Accordingly,the hearing of recording was offered to you. You have heard the recording of the proceedings on 28th May,2013. We have received your letter dated 29th May,2013,which was placed before the President and after perusing your above letter by the President,we are directed by the President,as per the decision of the managing committee,to inform you as follows.

We may recollect that on 22″ March 2013,at the Annual General Meeting of the Mumbai Cricket Association,you as an authorised representative of Wilson College Gymkhana,alleged to the effect that the office bearers of the Mumbai Cricket Association indulged in “Black Marketing of T-20 Ahmedabad match tickets held on 22nd December,2012.”

The said allegations were well published subsequently in press. Because of the said allegations of black marketing,the office bearers and the managing committee members faced embarrassment by their respective family members and the members of public,as well,thereafter. The old Mumbai players also expressed their displeasure over such working of the office bearers. The President of the MCA,as per the directions of General Body made inquiries in the said allegations leveled by you. However,the said publicly made allegations were found to be baseless on the perusal of documents available in the MCA records as well as subsequent confirmations from the concerned members of the sister Association,who requisitioned and accepted the tickets for that particular match and paid for the said tickets. The Managing Committee thereafter,on 1.4.203,unanimously decided to call upon you to provide specific proof in respect of the truth and correctness of the said serious,personal and embarrassing public allegations made by you within seven days.

Accordingly,on 9.4.2013 a notice was issued to you giving you opportunity to explain and give proof about the truth & correctness of public allegations made by you on 22.3.2013 in the AGM of MCA which you attended as the representative of Wilson College Gymkhana. On 16.4.2013,you replied the said notice in a very evasive manner and did not furnish any proof in respect of public allegation made by you in the AGM. You seem to have embarked on counter questioning the Managing Committee & the office bearers.

After considering the reply given by you,the Managing Committee came to the conclusion that you did not have any specific proof in respect of the allegations made of the black marketing of Ahmedabad T-20 Match tickets by the office bearers of MCA and that the said allegations were baseless,unsubstantiated and false.

The Managing Committee considered the tenor of the reply as well as reactions of member clubs,ex-players & responses of public to the press reports about the said allegations & reached the conclusion that the said false allegations were made in order to malign the reputations of the office bearers/member’s of the Managing Committee. The said derogatory remarks,casting aspersions of moral turpitude upon the members of managing Committee of MCA,which were false to the best of your knowledge and are extremely prejudicial to the reputation and interest of the Mumbai Cricket Association. The Public image of the office bearers and the members of the Managing Committee of MCA have been severely tarnished due to the false and unsubstantiated derogatory allegations made by you. A fair opportunity in the opinion of the Managing Committee was given to you by a letter dt. 9.4.2013,which was availed of by you on 16.4.201 3 and thereafter by allowing you the hearing the recording of the statements made by you. However,no proof about the truthfulness of the allegation have been submitted by you,thereafter any time.

With your letter dt. 29th April,2013,you have attached a transcipt of your audio recording and the statements made by you in the AGM on 22nd March,2013. You may observe the following wordings in your statement’

“Why was Mumbai Cricket Association’s money used for alleged black marketing of tickets in Ahlmedabad? I am making this allegation because this is is a serious matter.. .. .. ……..

What is the difference between Avi Sule and the office Bearers?”

On reading the above statements,your argument that you have not made any allegations of black marketing against any office bearers or members of managing committee cannot be accepted.

In the managing committee meeting held on 25th April,2013,the members of the managing committee heard the recording of the proceedings of the AGM held on 22nd March,2013 and were unanimous that you have made the allegations of black marketing by the office bearers of T20 match at Ahmedabad.

After giving the opportunity lo hear the audio recording of your statements at the AGM ,it was clear that there is no change in your stand and therefore a~ per the directions of the managing committee and the President,”we have been authorized to convey the following action against you.

Therefore in exercise of powers given to the Managing Committee U!/Rule 31 (h) read with rule 33,in the opinion of the managing committee the allegations made by you are of very serious nature and therefore it is unanimously decided to debar you for a period of five years with immediate effect i.e. from 3rd June,20 13 to 2nd June,2018 from participating in any matters pertaining to the activities of the Mumbai Cricket Association,for bringing disrepute to the Association and to the Office bearers,by making false and baseless allegations of black marketing of T20 match played at Ahmedabad on 22nd December 2012,acting against the interest of the Association by tarnishing the characters of the office bearers and the members of the Managing Committee of the Mumbai Cricket Association thereby causing serious prejudice to the public image of the Mumbai Cricket Association. Further,you shall not be permitted to represent any member dub of the Association,any tournament committee,any sponsor,franchisee,contractor or any person who has any relationship with the Mumbai Cricket Association. contractual or otherwise,during the said period of five years.
