Actor Aamir Khan’s counsel on Wednesday submitted in the Bombay High Court that it’s up to the copyright owner to decide whether to exhibit the movie or not and that the inquiry by the Competition Commission of India (CCI) in this regard is a form of harassment.

Khan’s counsel said the actor’s production house is just enforcing its copyright freedom when it comes to releasing its films and the CCI (a central government body) has no jurisdiction to initiate any inquiry in this regard. The competition commission had issued a showcause notice to Khan in December last year,based on its inquiry report which pointed out his involvement in coming together with other Bollywood producers and allegedly forming a cartel to corner multiplex owners in April last year. Khan had contended that he had no role to play in the alleged cartel and challenged the showcause notice,saying it was without jurisdiction.

Khan’s counsel on Wednesday told the Division Bench of Chief Justice Mohit Shah and Justice S C Dharmadhikari that apart from the issue of jurisdiction,the commission seems to have made up their mind regarding the inquiry against them. Additional Solicitor General Darius Khambata said that petitioners had come for a hearing before the commission which concluded last week. “Producers,film stars,cricketers and lawyers can demand any price,” said Chief Justice Mohit Shah.

Meanwhile,the central government had contended that the High Court in its jurisdiction cannot entertain a case at the stage of show cause notice and before the matter is contested at the appropriate tribunal.
