Police inspector Vinod Sawant, who recorded a murder case against lone arrested terrorist Ajmal Kasab for killing policemen Tukaram Omble with his AK-47 at chowpatty on November 26 last year, identified him in the special court on Thursday.

Sawant also identified the AK-47 seized from Kasab, deceased terrorist Abu Ismail Khan and the pistols seized from the Skoda car hijacked by the terrorists. Sawant also deposed in court that he directed all other policemen to take Omble, policemen Sanjay Govilkar to the hospital and the two injured terrorists,Kasab and Khan,to B Y L Nair Hospital.

Sawant also identified Kasab in the court as one of the terrorists who was nabbed by the D B Marg policemen after a fierce encounter, which lasted few minutes in the wee hours of November 27 last year. He further said that when he reached the spot, the two terrorists were lying unconscious while all the other witness who have deposed till now have told the court that Kasab was in his senses when he was overpowered and sent to the hospital.

However, special public prosecutor Ujjwal Nikam said outside the court,“Apart from the intensive arms, ammunition and explosives training allegedly given to the terrorists in Pakistan, they were also trained to act unconscious when they encounter policemen.”

Sawant,in his cross-examination by lawyer Abbas Kazmi, said: “Both terrorists (Kasab and Khan) were unconscious when I reached Chowpatty.” This statement contradicted the prosecution case that Kasab was ‘well-oriented and conscious’ despite being injured and had given his name, address, and age to doctors at Nair Hospital where he was treated.

In the court,Nikam made a plea before the court that he wanted to re-examine Sawant to seek ‘clarification’ on his statement. However,Special Sessions Judge M L Tahaliyani dismissed his plea stating that he cannot allow re-examination as “the version of this witness differs from the version of other witnesses”. Nikam then moved another application under section 311 of the Criminal Procedure Code recalling material witnesses but the court also rejected it.

Notes from The courtroom
Moneywise
