Many of the 35 wanted accused in the 26/11 case,who allegedly supported the attack six months ago,cannot be served non-bailable arrest warrants (NBWs) yet,because the police are still struggling to get their full names and addresses in Pakistan. The prosecution recently moved an application before special sessions judge M L Tahilyani seeking NBWs but the court sought the full names and addresses. That prerequisite will be a huge task for the Mumbai Police Crime Branch,which is grappling not only with unknown addresses but also with incomplete names such as Major General Sahab,Kharaksing,Usman,Aakib,Yusuf and Mursheed. Special public prosecutor Ujjwal Nikam confirmed having applied for NBWs. Due to technicalities like non-availability of complete names and addresses that the court has sought from us,we have not been able to get the warrants. it is just a formality which will be completed soon. We are closely working with central intelligence agencies to get the details, ACP Deven Bharati said,confident of providing the details at the earliest. Under the CrPC,once a non-bailable warrant is issued,the police execute it by going to the address of the accused,arresting him and producing him in the court. In this case,since the accused are based in Pakistan,the police will have to send the NBWs to the Ministry of External Affairs,which will forward it to Pakistan,which,in turn,will reply on the whereabouts of those named. If this does not happen,the court will issue a proclamation notice under CrPC section 82; if they dont appear within 30 days,they will be declared as proclaimed offenders.
