The Uttar Pradesh police have withdrawn its July 4 order,which had discontinued incentive allowance given to personnel from the level of constables to sub-inspectors posted in the intelligence wing.
The order,passed by Deputy Inspector General (Intelligence Wing),also sought recovery of the extra payment made to the personnel towards this allowance since October 20,2011.
The order,which was challenged by hundreds of personnel posted in the intelligence wing,was withdrawn on July 29.
The standing counsel of the state government informed the Allahabad High Court about the withdrawal following which a a dozen of petitions were disposed of as having become infructuous.
A single judge bench of Justice Sudhir Agrawal said with the government withdrawing the order,the petitions have become infructuous.
Rakesh Pande,counsel in one of the petitions filed by Vineet Kumar Mishra and 202 others,said,The intelligence wing personnel were being given the incentive allowance since 2007. However,an order was passed recently in which the allowance was stopped,citing a previous government order of 2011,in which the administration had sought to bring parity in allowances given to different categories of police personnel. Our argument was that the 2011 order did not contain anything to say that the incentive allowance should be stopped.
Another counsel,Vijay Gautam,appearing in two petitions on the same lines,said the intelligence wing personnel will get allowances between Rs 2,500 to Rs 1,000.
The July 4 order said in view of the government order passed on October 20,2011,the incentive allowance must be stopped. The 2011 order pertained to rationalising various allowances being paid to different categories of personnel, said Gautam. In all the petitions,the main ground for challenge was that the 2011 order did not mention anything about stopping the incentive allowance.
