No headway in case, cops file closure report for second time; kin move HC

Police filed for closure in a 2011 murder-rape case, relatives approach High Court seeking probe by CBI or state CB-CID

The Firozabad police, failing to work out a rape and murder case of a 16-year-old girl, has filed closure reports twice during the last two years. The relatives of the victim have now approached the Allahabad High Court, seeking a probe by the CBI or the state CB-CID.

On December 26, 2011, the Government Railway Police (GRP) had found the unidentified body of a girl stuffed in a gunny bag in a compartment of the Inter-City Express at Lucknow’s Charbagh station. The deceased was identified the next day with the help of the address printed on the bag.

Following this, the GRP had contacted the Firozabad police and come to know that a missing report for a girl of the same age had been filed with the Dakshin police station.

According to the complaint, the girl — a Class XII student — had left home for the market on December 25, 2011, but did not return.

Her family, along with the Firozabad police officers, came to Lucknow and identified the body. The postmortem report had stated that her throat slit was slit by sharp-edged weapons. The deceased and her two sisters used to stay with their maternal grandfather after death of their parents in 2004.

While investigating the case, the Firozabad police failed to identify or trace the accused. A reward of Rs 25,000 was also announced seeking information about the assailant(s). But on April 23, 2013, the police filed a closure report in the case, mentioning that the accused could not be identified or traced.

Later, following request by the victim’s family, the crime branch of the Firozabad police was asked to probe the case. Investigating Officer Siyaram Nimesh probed the case but he too failed to reach to any conclusion. He filed a closure report stating the same reason as given by his counterparts earlier. “I have sent the closure report to the circle officer, but do not know if it has been submitted to the court,” Nimesh said.

When contacted, the girl’s uncle said: “We had no idea that police have filed a closure report for the second time. We are not satisfied with the police investigation. We request the court to direct the police to solve the case. We also have filed a petition in Allahabad High Court seeking directions that the case be investigated either by the CBI or state CB-CID.”
