A local court in Faizabad on Tuesday convicted former BSP MP Mitrasen Yadav in a case of embezzlement. Additional Chief Judicial Magistrate Anil Shukla,who delivered the ordered,has fixed December 21 to announce the quantum of punishment.
The court also issued non-bailable warrant against Yadav as he was not present in the court.
Mitrasens lawyer Avadesh Yadav, who confirmed that court had held him guilty,said an application was moved in the court on behalf of Mitrasen praying to excuse him for not attending the proceedings.
The court,however,acquitted Mitrasen under section 420 of the IPC (cheating and dishonestly inducing delivery of property). Samajwadi Party has declared Mitrasen as its candidate for assembly election from Bikapur constituency in Faizabad.
The case dates back to 2001 when Hari Om Yadav,a clerk with Kishan Vidhyalay High School,Bankhata,filed an FIR against Mitrasen,who was then manager of the school,and his son Anandsen Yadav. He alleged that the manager had committed a fraud by not depositing money earned from the field attached with the school.
As per then report of tehsildar in 1981,the earning from the field was Rs 3,100 annually, said special public prosecutor advocate KK Pandey. The Faizabad police investigated the case and filed chargesheet against Mitrasen under section 420 and 409 of the IPC.
