After the Raja of Mehmoodabad and Shia clerics,the Jamat-e-Islami,an orthodox organisation of Sunni Muslims,has voiced its protest against the Enemy Property (amendment and validation) bill,pending in Parliament for consideration and passage.
The Bill carries certain controversial provisions which directly interfere with the Muslim Personal Law (Shariat) Application Act 1937, said Mohammed Ahmed,state president of the Jamat-e-Islami. The Section 4 (A) of the Bill invalidates the provision of oral gift,which is part of the Muslim personal law.
The Section 4 (A) of the Bill also prohibits the transfer of any property declared as enemy property through oral will.
The Jamat leader said Section 18 (B) of the Bill gives enormous powers to the Custodian of Enemy Property and makes high courts and even the Supreme Court redundant. This section of the Bill states: No court shall have jurisdiction to order divestment from the Custodian of Enemy Property vested in him under this act,or direct the government to divest such property from the Custodian.
If this Bill is passed in the present form,it will be a body blow to Muslims,since all properties confiscated under this Act belong to Muslims. If this Bill becomes law,then all properties declared as enemy property will remain under the possession of the Custodian of Enemy Property, he said.
Referring to the controversy over the properties of Raja Mehmoodabad in Lucknow,Ahmed said: An effort is being made by vested interests in Lucknow to mislead the Union government to create an impression that the proposed Enemy Property ( Amendment and Validation) Bill 2010,is just about the Raja of Mehmoodabad.
This issue concerns all Muslims across the country whose properties were acquired under this Act. The Raja of Mehmoodabad is a bonafide citizen of India and has every right to claim his properties,he added.
