The Allahabad High Court on Thursday reserved its judgment on the application filed by the dentist couple Rajesh Talwar and Nupur Talwar seeking the courts directive to the CBI to bring on record the sound simulation and the narco-analysis test report.
The court has fixed July 16 for pronouncing the judgment. The trial of the case in the special CBI court in Ghaziabad will continue to remain stayed.
The Talwars are facing trial for the alleged murder of their daughter,Arushi Talwar,and domestic help,Hemraj,on May 16,2008,at their house in Noida.
A single-judge bench of Justice Sudhir Agarwal reserved the judgment after hearing both the parties.
After the trial court rejected the application,the Talwars approached the high court and argued that the CBI must bring the sound simulation test report on record,as it was part of the evidence. They had also sought the narco-analysis test report.
The trial court had rejected their application,saying the reports were merely opinion of the experts and would not affect the right to fair trial of the accused. The high court,however,said that the matter required consideration. It has also stayed the trial until the disposal of the application.
CBI counsel Anurag Khanna had opposed the application saying the sound simulation test report was irrelevant to the trial,while the narco-analysis test report was not admissible as evidence.
