The Pilibhit police is likely to file the chargesheet against BJP parliamentarian Varun Gandhi in the Chief Judicial Magistrate court in Pilibhit on Monday.
The chargesheet will be filed under Section 153 (A) promoting enmity between different groups on grounds of religion,Section 125 of the Representation of the People Act,295 (A) deliberate and malicious act intended to outrage any class by insulting its religion and Section 505 (2) statement creating/promoting enmity,hatred or ill will between classes.
Varun is accused of making an inflammatory speech in Barkhera in Pilibhit on March 8. The chargesheet contains statements of 39 witnesses, a compact disk,a handycam, a cellphone and a report from the Forensic Science Laboratory,Chandigarh.
While the compact disk and the handycam contain the recording of the Barkhera speech,the memory card of a cellphone contains the Desh Nagar speech delivered by Varun on March 7.
The three items were arranged after Varun refused to give a sample of his voice to the police. Varun had alleged that the recordings of his speeches had been doctored and there was a political conspiracy to defame him. These are not my words and not my voice, said Varun,after the footage was aired on television channels.
Two FIRs were lodged at the Barkhera police station against Varun.
The first FIR was lodged on March 17 by the district police and the second was lodged by District Magistrate,Pilibhit on March 19 on the directive of the Election Commission.
Both FIRs were clubbed since they contained the same details.
