The CJM court granted interim bail on Wednesday to Gurjant Singh,the truck driver who allegedly rammed a security vehicle in the convoy of Mamata Banerjee on August 9.
Judge Gopal Kumar Dalmia said Gurjant will not be allowed to leave the state without the permission of the court and he will have to meet the investigating officer of the CID once a week. He will have to appear in court on September 8. After going through the case diary,the court held that prima facie,there was not sufficient evidence on the allegation of attempt to murder and criminal conspiracy.
Moving the bail petition,Gurjants counsel advocate Manjit Singh questioned the progress of investigation during the 14-day remand of his client. Two cases could not be started on a single incident,he said. There was not enough material in the case diary which substantiated that it was a fit case of attempt to murder and criminal conspiracy,he argued.
The CID placed the mechanical report along with the case diary before the court. According to the report,brake of the vehicle had failed,said public prosecutor Safirul Ali Khan. Only the forensic report,which is yet to reach the CID,can say whether the brake failure was intentional or a mechanical fault,he said. Opposing the bail petition,Khan said the helper of the vehicle was absconding after the incident and Gurjant did not help the CID trace him.
Tapan Aditya,the CID investigating officer,said the attempt to murder case was lodged on basis of the complaint by Suvendu Adhikary. Since Mamata Banerjee was allegedly injured in the incident,her medical report was also important. But the document,he said,was not available with the CID.
