Bail rejected,CM nephew in day-long custody

An Alipore court rejected the bail petition of Akash Banerjee who was arrested for allegedly assaulting a police inspector at Kidderpore.

An Alipore court today rejected the bail petition of Akash Banerjee,nephew of Chief Minister Mamata Banerjee,who was arrested on Wednesday along with three others for allegedly assaulting a police inspector at Kidderpore.

The court of the second chief judicial magistrate remanded them in jail custody for one day. Police have been directed to produce the case diary tomorrow.

On Wednesday,police arrested Akash and his associates Nitish Kumar Singha,Amit Kumar Mishra and Md Kamaruddin on the basis of a complaint lodged by an inspector of the traffic department. According to the FIR,Akash and his aides allegedly obstructed the on-duty police inspector and assaulted him. The policeman had reportedly intercepted their car for violation of traffic rules. In protest,Akash assaulted him.

Moving the bail petition,advocate Shantanu Dutta,counsel for Akash,pleaded that he wanted the seizure list from the police inspector and he refused to give it. Dutta said Akash never assaulted the police inspector and no medical report was produced in court.

The police brought charges under Sections 341,323 and 353 and 114 of the IPC against Akash. Only 353 — assault of a government official during his duty— is a non-bailable offence.

The police requested the court for judicial remand of the four for 14 days. Pijush Kanti Mondal,public prosecutor,opposed the bail plea on the ground that Section 353 was brought against Akash and the investigation was under way. Following the submission,Sukanya Roy,the CJM judge,rejected the bail pleas.

Akash was reportedly released by the police ten minutes after being picked up. According to sources,Akash would not have been picked up had there not been a public agitation and demonstration by Congress workers and supporters. However,police released him immediately after a cabinet minister sent a group of senior Trinamool leaders to Watgunj police station.

Special CP Shibaji Ghosh said,“We have ordered an inquiry into the incident of releasing him and then re-arresting him. We are yet to receive the report.”
