The special fasttrack court hearing the Uber cab rape case on Monday framed charges of rape and kidnapping against the accused driver Shiv Kumar Yadav.

Additional Sessions Judge Kaveri Baweja framed the charges for offences under Sections 376 and 366, among others.

Yadav is now formally accused of “committing rape and causing grievous bodily harm or endangering life of a woman, kidnapping or abducting a woman with an intent to compel her for marriage” and criminal intimidation, under the Indian Penal Code.

Drama ensued in the courtroom when Yadav, after pleading not guilty, refused to sign the chargesheet. Arguing before the judge, Yadav alleged that arguments on framing of charges took place in his absence and that he was not given a chance to get a defence lawyer.

However, after the court assured him that due process of law is being followed and nothing wrong has been done against him during the proceedings, the accused agreed to sign.

The court will begin the trial on a daily basis from this Thursday.

Police had filed the charge sheet 19 days after the incident on the night of December 5 last year when the victim, who worked for a finance company in Gurgaon, was headed home to Delhi’s Inderlok area.
