In the first case in Delhi under new penal code BNS, a street vendor near Kamla Market booked for encroachment

The street vendor was booked under Section 285 of Bharatiya Nyaya Sanhita (BNS), 2023, said the Delhi Police.

In one of the first FIRs under the new Bharatiya Nyaya Sanhita (BNS), 2023, which comes into effect from Monday, July 1, a street vendor in Central Delhi’s Kamla Market was booked for encroaching space near New Delhi Railway Station and selling mangoes and other items.

According to the police, the First Information Report was lodged under Section 285 of BNS, which pertains to danger or obstruction in public way or line of navigation, at 12.15 AM on July 1. Sub-Inspector Kartik Meena of the Kamla Nagar Police Station, the investigating officer (IO) in the case, said he was patrolling near the New Delhi Railway Station area on June 30 when he saw a person selling mangoes and setting up a stall near the public washroom under the foot-over-bridge near the railway station.

“He (accused) was selling mangoes after setting up his stall, apart from selling water, cigarette and other items, hence creating encroachment to the path and blocking the public’s way… He was told repeatedly to remove the stall on the said day, however, he did not abide by the directions,” the FIR said.

The accused was identified as Pankaj Kumar, 23, a resident of Bihar.

The Bharatiya Nyaya Sanhita (BNS), the Bharatiya Nagrik Suraksha Sanhita (BNSS), and the Bharatiya Sakshya Adhiniyam (BSA) are the country’s new criminal laws passed in Parliament in December 2023. These laws replace the Indian Penal Code (IPC), 1860, the Criminal Procedure Code (CrPC), 1973, and the Indian Evidence Act, 1872, respectively.
