A man,who went missing 11 years ago,has been declared presumed dead by a Delhi court on his sons petition.
Additional Senior Civil Judge Gautam Manan declared Sohal Lal dead as per the provisions of the Indian Evidence Act,which stipulates that a man not seen or heard of for the last seven years may be presumed dead.
The court order came on Central Delhi resident Vinod Kumars plea,stating that his father went missing on May 29,2000,and a report was lodged at the police station in the first week of June 2000.
Sohal Lal could not be traced despite every effort,and the police finally declared him untraceable. As per the Section 108 of the Indian Evidence Act,a person is presumed to be dead if he is not heard (of being) alive for more than 7 years. It is in evidence that Lal has not been heard (of being) alive since 2000 and despite efforts by the police,he could not be traced, the court said.
