‘I’m retired now, don’t know how many more years I can fight’: Jaypee homebuyers protest delay in flat delivery

Construction has remained stalled even after the National Company Law Tribunal (NCLT) approved the resolution plan.

Raising slogans of ‘Suraksha se raksha’ and ‘hamare ghar humein wapas do’, around 100 homebuyers of Jaypee’s Wish Town project protested outside Jaypee School in Noida’s Sector 128 on Thursday against the delay in delivery of their homes.

“We never thought we would see a day like this,” said KC Das. The 75-year-old had booked a 3-BHK flat at Jaypee Wish Town in 2011. “I thought I would leave this property to my son but now I am the one staying in his house. There is nobody to listen to a common man. I am retired now, I don’t know how many more years I can fight,” said Das.

Suraksha Realty could not be reached for comment.

The affected homebuyers demanded that the construction be renewed, which has remained stalled even after the National Company Law Tribunal (NCLT) approved the resolution plan in March 2023. Suraksha Realty took over the debt-ridden Jaypee Infratech Limited (JIL) on May 24, 2024.
“Over 22,000 homebuyers are still waiting for basic resumption of construction. After waiting patiently for nearly 21 months, the JIL Real Estate Allottees Welfare Society (JREAWS), which represents the collective voice of the homebuyers, has filed an application in the NCLT. It is scheduled to be listed on April 15,” said the president of the association, Ashish Mohan Gupta.

Among those protesting was an elderly couple, Indu, 78, a retired professor from IIT Roorkee, and her husband Pradeep Kumar, 72. “I retired around 2012-13. We booked the flat with the money that I received post-retirement. It was over a crore,” she said.

At present, there are 97 towers across several stalled projects in Noida (Garden Isles, Krescent Homes, Kasa Isles, Kube, Pebble Court, Wishpoint, Orchard, and Kosmos among several others).

“Despite receiving all necessary clearances, Suraksha Realty has failed to demonstrate a sincere commitment to beginning full-scale construction. We had thought that things would change but all that they did was to give us a new timeline, from Diwali to Holi,” said Prem Singh Chauhan, 75.

Homebuyers also pointed out that the resolution plan mandated 12,000 labourers to meet construction deadlines. “Presently, only around 2,000 workers are deployed across 150 towers, leading to a near standstill. All that they have given us is excuses. At times, they will say that GRAP (Graded Response Action Plan that kicks in during pollution season) is in force, or then they will say it is the rainy season — it never ends,” said Chauhan, a retired BSF DIG.

Another protester said the promised mobile application for updates on construction, dues, and milestone alerts has not been developed.

Shankar, an IT professional, who goes by a single name, said it’s like a loop. “We struggle between EMIs, rent, and constant shifting. I broke my fixed deposits, took loans, and sold property to book a flat. I was 40 back then, today I am 57. I will retire soon and still won’t have a house.”
