Even as the father of slain B Tech student Shobhit Modi sought the transfer of the murder case to the Central Bureau of Investigation (CBI) on Thursday,the Delhi High Court wondered if the probe agency was indeed suitable for investigating an issue such as this.
We may have no problem with transferring the investigation to the CBI,but the question is whether the CBI is the specialised agency to probe a murder case, observed Justice Mukta Gupta,even as the hearing began. The 20-year-old student was stabbed by unknown assailants near his house in Vasant Kunj on May 5.
During the hearing,Suraj Modis counsel claimed that the Delhi Police was not interested in investigating the case properly,and had failed to look into several important clues. Insisting that Shobhits murder was linked to his relationship with a girl,Modis counsel said the police had been deliberately ignoring his requests to probe the case from that angle.
Challenging the status report of the police,which mentioned neither the names of any suspects nor a motive behind the crime,Modis counsel said they had failed to carry out even basic investigation into the case.
Shobhits computer and mobile phones were not
analysed properly and,in fact,his mobile phone was tampered with around the time of his
death. This is evident because records of calls made to or by him between 6.06 pm and 9.47 pm have been erased, the counsel claimed.
He said the police had not investigated the matter in accordance with the events that occurred on the fateful day,and a conspiracy angle could not be ruled out.
As Modis counsel wrapped up his arguments,the court scheduled hearing of Delhi Police arguments for Friday.
With the nine-week-long investigation of the police into the murder drawing a blank,Modi had moved the High Court in July,stating that the family had lost all faith in the local police.
He was in favour of a CBI investigation in the issue,the victims father added.
Shobhit,a second-year IT student at Faridabads Manav Rachna University,was stabbed near the gate of his residence in Vasant Kunj,South Delhi,while he was on his way home from DLF Promenade Mall.
