Four days after a speeding Haryana Roadways bus ran over a cardiologist at Medanta Medicity Pankaj Gupta and his four-year-old daughter Liveshiya, Gurgaon police on Friday re-arrested the bus driver, Harish Singh. Singh had been released on bail after his arrest on April 21, the day of the accident.

“After DCP (East) visited the spot, she decided that the accused should be booked for culpable homicide not amounting to murder. So Section 304A (causing death by negligence), under which the accused was first booked in the FIR, was converted to Section 304 Part-II on Thursday. Following this, the accused has been re-arrested,” Gurgaon Police Commissioner Alok Mittal  said.

Inclusion of Section 304 Part-II makes it a non-bailable offence, wherein if found guilty, the accused can get up to 10 years in jail as opposed to the bailable offence under Section 304A, for which the maximum punishment can only go up to two years.

On Friday, a forensic team visited the accident spot, trying to reconstruct the sequence of events. They collected hair and blood samples among other pieces of evidence.

Meanwhile, Gupta’s wife, Jyoti, has been admitted to Medanta Medicity where she is undergoing treatment. According to family members, she “fainted repeatedly after the incident, even at the cremation site, and is psychologically fragile”.

“Sometimes, she talks normally and seems fine. But, the next minute, she will break down,” a family member said.
Jyoti’s uncle Rajeev Bhadoriya said a group of senior officials from the Gurgaon administration had also come to meet Jyoti on Friday, but was refused permission.

“They (administration officials) have assured us that she will be given a job, so that she can support herself and her six-month-old daughter. They said the case will be looked into and strict action will be taken,” Bhadoriya said.

“We had also sent a letter to senior police officers stating our dissatisfaction with the way the investigation was proceeding. We have urged police to do everything they can to ensure that the culprit gets punished,” Bhadoriya said.
