(File Photo)The Central Bureau of Investigation (CBI) recently raided the Rohini cyber police station in Delhi and arrested a sub-inspector allegedly demanding a bribe of Rs 14 lakh from a Mumbai-based businessman, an accused in a cyber fraud case.
As per the CBI’s submissions before a Delhi court, SI Rahul Malik sought the bribe to prevent the arrest of the accused and his relative in the case. Fakih Mohammad Rehan Hajtay lodged a complaint stating that Malik asked for a bribe of Rs 14 lakh as an “undue advantage” for helping him in the cyber fraud case.
The CBI submitted that a man named Pankaj accepted a bribe of Rs 2.5 lakh in Mumbai from the complainant on behalf of the SI on March 19.
When Malik learned of the CBI team’s visit, he tried to run from the police station, the agency alleged. As per the CBI’s allegations, its team was misled at the station that Malik was in a meeting in the station house officer’s room. After a chase that lasted several minutes, the SI was captured by the CBI team near the police station.
Public Prosecutor Jyoti Solanki, who represented the CBI, argued before the court that Malik attempted to destroy evidence by disposing of mobile phones. Two of his phones were recovered, and the CBI team discovered that some “incriminating” WhatsApp messages had been deleted.
Advocate Vijay Aggarwal, who represented Malik in court, argued that the complainant’s criminal record is not clean. The counsel also argued that the CBI manual had not been followed as no photography or videography of the proceedings was conducted.
“In my opinion, considering the case of the CBI, the photography or videography could not have been conducted once the accused attempted to flee,” the court said.
Special Judge Gaurav Rao of Rouse Avenue Court, in his order dated March 20, said, “Therefore and considering the conduct of the accused as discussed above as well as gravity of the offence, he is remanded to one-day transit remand.”
The court also said that the accused was to be produced before the special CBI judge in Greater Mumbai the next day. The court added that he should be medically examined before his departure from Delhi and immediately upon his arrival in Mumbai.
