Dec 16 ‘robbery case’: No witnesses for defence, court lists matter for final arguments

Delhi police have alleged that before raping a 23-year-old girl in a moving bus on the night of Dec 16, 2012, the accused had lured a carpenter, Ram Adhar, into the vehicle and robbed him.

A Delhi court has closed the right of the four convicts of the Delhi gangrape case, who have been sentenced to death, to lead further evidence in their defence in connection with a case of robbery in which they are facing a trial.

After the four death row convicts failed to produce any witness in the six hearings of the case, the court listed the matter for final arguments.

“For the past six consecutive dates, no witness has been brought by the accused persons in their defence. In these facts and circumstances, I close their right to lead further defence evidence. List the matter for final arguments on July 14,” said Additional Sessions Judge Reetesh Singh.

Delhi police have alleged that before torturing and raping a 23-year-old girl in a moving bus in the capital on the night of December 16, 2012, the accused had lured a carpenter, Ram Adhar, into the vehicle and robbed him.

The four men had earlier claimed that they had not robbed or assaulted the complainant. But Ram Adhar had identified them, in court, as the men who had robbed and assaulted him that night.

During the trial in the robbery case, the court had recorded the statements of 37 prosecution witnesses, including the carpenter.

The four men are facing charges under various sections of the Indian Penal Code, including sections 395 (dacoity) and 365 (kidnapping or abducting with intent secretly and wrongfully to confine a person).

The police, in their 15-page chargesheet filed on March 15, 2013 in the robbery case, had alleged that bus driver Ram Singh, his brother Mukesh, Vinay, Pawan and Akshay, along with one juvenile, had snatched Ram Adhar’s mobile phone and Rs 1,500 after luring him into the bus.

The trial court had abated charges against main accused Ram Singh over the gangrape case, after he was found dead in his cell in Tihar Jail on March 11, 2013.
