Court orders probe against cop for forging evidence

Observing that a witness could not be allowed to “pollute the stream of justice by making a false statement on oath”,a city court has ordered registration of a case against an assistant sub-inspector (ASI) of the Delhi Police for falsifying evidence in a suicide case.

The court of Additional Sessions Judge Kamini Lau has also asked police to conduct a departmental inquiry against ASI Kanti Prasad,for fabricating a dying declaration of a girl who had committed suicide.

The woman’s mother had filed a police complaint stating that the 20-year-old had poured kerosene and set herself on fire because a man had refused to marry her.

Doctors testified that the woman had died within 24 hours and had not gained consciousness at any point to give a statement. The court also noted that the declaration was not endorsed by any doctor,and contained the thumb impression of the woman,despite the fact that she was educated and could have signed.

The court has directed the registration of a complaint under Section 195 of the CrPC to conduct an inquiry against the police officer. The court has also sent a copy of the judgment to the police commissioner for “appropriate action against the erring officers in accordance with law”.
