A day after AAP Rajya Sabha MP Sanjay Singh was granted bail by the Supreme Court following his arrest six months ago in the Delhi excise policy case, a Delhi court Wednesday allowed him to campaign across the country but said he will have to share his itinerary with investigators and keep his phone’s location active.
According to the bail condition set by the Supreme Court, Singh cannot make any comment regarding his role in the excise policy case.
At the Rouse Avenue Court, Special Judge Kaveri Baweja initially said that a condition not allowing Singh to leave the Delhi-NCR can be imposed.
Singh’s counsel, Advocate Rajat Bharadwaj, told the court that since the Lok Sabha election campaign was underway, the MP would need to go to various places for campaigning. This was followed by a request to set the condition that Singh would not be allowed to leave the country.
Granting permission, Judge Baweja said that if Singh leaves the NCR, he must share a detailed itinerary with the investigation officer and keep his phone location on at all times.
While granting bail to Singh Tuesday, the Supreme Court had said that the trial court would decide his bail conditions.
Singh’s lawyers and his wife Anita were present in the court Wednesday.
Bharadwaj told Judge Baweja that the MP was not a flight risk. He said that barring one bail condition (not speaking about his role in the case), the rest of the bail conditions have to be fixed by the trial court.
The court directed that Singh must surrender his passport, not tamper with evidence, join investigation and provide his phone number to the investigation officer and follow the conditions imposed by the Supreme Court.
Singh was arrested by the Enforcement Directorate on October 4, 2023 in the excise policy case on the charge that Rs 2 crore illegal cash changed hands at his Delhi residence.
On Tuesday, he was granted bail by the Supreme Court after the ED did not oppose his bail application, hours after its counsel, Additional Solicitor General S V Raju, was reminded by the court that the “money has not been recovered” and he should “take instructions whether you really require him now after six months”.
