A petition,alleging sedition against Congress General Secretary Rahul Gandhi and author-activist Arundhati Roy,was dismissed as withdrawn,by a Chandigarh court on Saturday,after petitioner advocate Arvind Thakur,did not pursue the case stating he would file a fresh petition impleading more people.
The Chandigarh court,on October 29,2011,had issued notices to Gandhi and Roy after Thakur,chairperson of the Global Human Rights Council,had sought directions from the court to restrain the duo from making uncivilised statements,which,he alleged,were creating an unhealthy atmosphere across the country.
As the case came up for resumed hearing on Saturday,advocate K C Mittal,appearing on behalf of Rahul Gandhi,contended that the petition was not maintainable and that Thakur had no locus standi in filing such a petition. On the other hand,Thakur submitted that after perusing the replies of Arundhati Roy and Rahul Gandhi,there was a need to implead more respondents. Hence,Thakur added that he will file a fresh petition.
Campaigning in Bihar,Rahul Gandhi had compared the RSS (Rashtriya Swayamsevak Sangh) with SIMI (Student Islamic Movement of India),which is a banned organisation. This was a tactic to win a vote-bank and is highly unconstitutional as it could even lead to riots, Thakur had alleged in his petition.
Arundhati Roy had drawn flak over her controversial remarks on Kashmir.
During a recent speech,Arundhati Roy had said that Kashmir was never an integral part of India. She had also supported the Maoists and has said that their path of violence was appropriate, the petitioner had alleged.
