PVR Cinemas has won an appeal in the UT Consumer Disputes Redressal Commission against an earlier order by the district consumer forum for deficiency in service.
In May 2011,the complainants,Sudhir Chauhan and Saroj Malakar purchased two tickets at PVR Centra Mall to watch the 3D movie,Haunted. The two later alleged cheating by the cinema hall as the movie was not shown with 3D effect as per the advertisement in the pamphlet. The multiplex stated that the poster of the movie advertised in the pamphlet was not the creation of PVR Cinemas but by the movie makers and it mentioned that the movie was created using 3D technology,no that PVR Cinemas was playing it in 3D technology.
It was further stated that the viewing of movies in 3D technology was introduced in PVR Cinemas,only in June while the complainants had watched the movie in May. The cost of the ticket purchased by the complainants was Rs 90 each,whereas,the cost of the ticket for a 3D movie was Rs 175. The show timings printed also did not mention that the movie was being shown in 3-D.
In the earlier judgement, the forum had directed PVR Cinemas to pay Rs 50,000 as compensation and additional litigation costs of Rs 5000 to the complainants. The commission has accepted the appeal and the impugned order of the district forum has been set aside.
