PCA asks for inquiry against sub-inspector for abusing powers

For his gross abuse of power,the Police Complaints Authority (PCA) has recommended a departmental inquiry against Chandigarh Police Sub Inspector Sewak Singh posted at Sector 3 police station.

The case dates back to May 2010,when Col (Retd) Amardeep Singh saw his brother’s domestic help and few other boys plucking fruits from the trees in his ground floor garden. When he objected,his nephew Shahbazdeep Singh,who was later joined by his sister-in-law,assaulted him. Amardeep had alleged that his nephew was carrying a stone in one hand and a pistol in the other. Amardeep wife,who had came to his rescue,was also allegedly assaulted.

Amardeep informed the police,but Investigating Officer SI Sewak Singh did not record his statement and was taken to a hospital and then put under preventive arrest. He was produced before the SDM after 17 hours who orally admonished SHO Mahavir Singh and SI Sewak Singh for the severe action against the complainant and for not taking a similar action against the other party.

The order reads,“The two police officers namely SHO Mahavir Singh and Sub-Inspector Sewak Singh are found to have acted in the most arbitrary and partisan manner while arresting one party and leaving the other party scot free. They acted in an arbitrary,biased and mala fide manner in detaining Amardeep Singh overnight. It was an unreasonable action and gross abuse of power. The complainant,being a formed senior officer of the Army was treated in a cruel and most humiliating manner by keeping him in police lock up for 17 hours.”

The PCA has recommended that since SHO Mahavir Singh has retired from service,no action is proposed against him. Sub-Inspector Sewak Singh is ordered to be shifted to police lines forthwith and to face a departmental inquiry for disciplinary action against him for his mala fides,arbitrariness,gross misuse of power and misconduct.
