A local court has sentenced a man to six months’ simple imprisonment in a cheque bounce case and directed him to pay Rs 2.5 lakh compensation to complainant Jagdeep Singh.
The order was passed by Judicial Magistrate First Class (JMIC) Abhay Rajan Shukla, who held Dalvir Singh guilty under Section 138 of the Negotiable Instruments Act.
According to the complaint, in October 2020, Jagdeep had advanced Rs 1.65 lakh to Dalvir Rs 55,000 in cash and Rs 1.10 lakh through cheque. Dalvir encashed the amount and issued a cheque for Rs 1.65 lakh in return. However, the cheque bounced due to “drawer’s signature mismatch”. Despite receiving a legal notice, he did not repay.
Dalvir, in his defence, claimed he never took any loan and that Jagdeep had stolen the cheque from his property dealer, Naresh Kumar Mittal. But the court found contradictions in his statements, noting he alternately denied the signatures and claimed the cheque was stolen.
The court said Dalvir failed to prove his claims or explain why no police complaint was lodged if the cheque was stolen. He has been directed to pay the compensation within one month.
