Lt Gen Sahni granted bail

The Chandigarh Bench of Armed Forces Tribunal granted bail to Lt Gen SK Sahni (retd),who was sentenced to three years rigorous imprisonment apart from cashiering by a General Court Martial on February 18 at Jalandhar.

The Chandigarh Bench of Armed Forces Tribunal (AFT) today granted bail to Lt Gen SK Sahni (retd),who was sentenced to three years rigorous imprisonment apart from cashiering by a General Court Martial (GCM) on February 18 at Jalandhar. He was asked to furnish a bail bond of Rs 50,000.

Before the order,senior panel counsel Gurpreet Singh,representing the Union government,submitted that Sahni could influence witnesses in allied cases to be started soon. He added that during the course of trial,instances of Sahnis attempting to influence or contact witnesses were observed wherein the court was constrained to formally report on the matter for the attention of superior authorities

He said that Lt Gen Sahni was involved in feeding substandard food to troops,while being at the helm of affairs and hence should be denied bail.

On the other hand,Col NK Kohli (retd),counsel for Lt Gen Sahni,submitted in the court that the sentence by GCM was yet to be confirmed and his client had served for around seven months in close arrest. He added that there was no finding by the court that Lt Gen Sahni took money or acted secretly.

The Bench comprising Justice Ghnasyam Prasad and Lt Gen HS Panag (retd) commented that the apex court had ruled for bail in cases where the punishment is up to or less than three years,before allowing the bail.

It was also ordered that Lt Gen Sahni could not leave the country without permission and must submit his passport. Lt Gen Sahni was convicted on six charges related to intent to defraud in procurement of masur whole and kabli channa and also for acts prejudicial to military order and discipline. He is the second officer of the rank of Lt Gen to be punished by a GCM and the first officer of such a rank to be cashiered.
