HC fines Ludhiana NGO for helping inmate who ‘faked’ pregnancy

To obtain bail,not only did she allegedly fake her pregnancy but also claimed that her ‘new born baby’ had died inside the Ludhiana Jail. The district and sessions judge of Ludhiana,however,submitted a report in the Punjab and Haryana High Court on Thursday stating that Balwinder Kaur,a jail inmate,had lied all along.

The report,as demanded,was submitted on Thursday during the resumed hearing of a public interest litigation filed by a Ludhiana-based NGO. Taking stock of the report,the high court on Thursday dismissed the petition filed by NGO through its Chairman,Satnam Singh Dhaliwal and imposed a penalty of Rs 20,000 on Dhaliwal.

Questioning the credentials of the petitioner,in his report,the District and Sessions Judge Ludhiana also observed that the petitioner (Dhaliwal) has over 40 criminal cases pending against him.

The Bench had directed Ludhiana Session judge to conduct a probe. The report of session judge stated that pregnancy was found to be positive by a doctor in Banga civil hospital who had held that she was eight months pregnant. It was alleged that delivery was due on April 13,2010 whereas she delivered a dead female child on September 9,2010. “The eight months pregnancy was not noticeable,it could not be believed. Inference can be drawn that the report of Banga civil hospital was manipulated” read the report of Sessions Judge,Ludhiana.

The petitioner had moved the high court alleging negligence by the doctors. The petitioner had alleged that Balwinder Kaur,accused in a murder case had delivered a dead foetus on September 9,2010 in Ludhiana jail. Kaur had informed the doctors in jail and at the civil hospital about her pregnancy but they did not believe her and treated her for a cyst,Dhaliwal had alleged.

The Sessions Judge stated that if the due date of delivery was April then it was also not possible to retain the child till September.
