HC dismisses all petitions against PCS results

In a significant development,the Punjab and Haryana High Court on Friday dismissed all petitions filed by reserved category candidates who had not been short-listed to appear in the main examination for appointment to the Punjab Civil Service(Executive Branch) and other allied posts. The results of the preliminary examination was declared in December 2010

The petitioners,who belong to either of the reserved categories (BC,SC,ex-servicemen) had contended that candidates belonging to the reserved categories,who had secured more marks than the last short-listed candidate in the general category,should have been included in the general category,thus allowing an equal number of candidates of reserved categories to be short-listed in their respective categories.

Appearing on behalf of the State,Additional Advocate General (AAG) Puneet Gupta had submitted that the preliminary examination had been conducted strictly in accordance with the mandate of the rules. The rules envisage application of the reservation policy at the stage of the preliminary examination to a limited extent. Puneet Gupta submitted that accordingly every reserved category candidate had been sufficiently provided an opportunity to compete for the main examination and 13 times candidates from each reserved category have been short-listed and declared qualified to appear in the main examination.

Justice Permod Kohli,in his 36 page-long judgement,while dismissing all the writ petitions,concluded that the petitioners principle does not apply at the stage of short-listing the candidates on the basis of the preliminary examination result. The Court ruled that it will be applicable only after the result of the Main Examination and Viva Voce test are declared and when a final merit list of successful candidates is to be drawn. Justice Kohli observed that the marks of the preliminary examination are not added to the marks of main examination and viva,and that the preliminary examination is just held to short-list candidates for the open competition which commences with the main examination.
