Amritpal was brought to the jail on April 23 after he was arrested from Moga district in Punjab.
(File) The Punjab and Haryana High Court has issued notice to the Centre and the state of Punjab over a habeas corpus petition filed by Gurmeet Singh Gill, allegedly an accomplice of Waris Punjab De (WPD) chief Amritpal Singh, seeking his immediate release from “unlawful custody” as ordered by the Amritsar District Magistrate.
Hearing the matter, Justice Manjari Nehru Kaul asked the Centre and the state government to file their reply by July 10. The accused is currently lodged at Dibrugarh Central Jail in Assam.
The counsel for the petitioner Gurmeet Singh Gill alias Gurmeet Singh Bukkanwala contended that his detention order dated March 18, 2023, along with the approval order dated March 25, 2023 and another order dated May 2, 2023 – vide which a representation of the petitioner was dismissed – had been passed on the ground that he was part of a mob which had attacked and ransacked Ajnala police station on February 23, 2023.
The counsel pointed out that it was a matter of record that on the said day, the petitioner was at the Talwandi Bhai police station in Ferozepur district. Further, the counsel submitted that it was also a matter of record that the petitioner was released only at 5 pm, well after the aforementioned incident in Ajnala had taken place.
