Court rejects plea,denies bail to MLA

The Chief Judicial Magistrate (CJM),Bhawna Jain,on Tuesday denied bail to Doon MLA Ram Kumar Chaudhary,who has been charged for the murder of 24-year old Jyoti Kumari.

Jain announced the orders while rejecting the plea by Chaudhary that the police have failed to file a complete challan in the case within a period of 90-days. The MLA is currently lodged at central jail Ambala along with other accused,Dharmpal,Gurmeet,Paramjeet and Tilak Raj,for killing the girl by running a truck over her and later leaving the body at Sector 21.

Public prosecutor,Surinder Bairagi,said the court rejected the bail after upholding the contention made by the state that they have managed to file the challan within 90 days.

Chaudhary had moved an application before the court contending that since the police have filed only an incomplete challan it is as good as filing a “no challan” and that he should be granted bail.

Counsel for the accused,Amandeep Bindra,said they had moved an application stating that the challan in the case was incomplete and the police have not provided a list of documents to the accused which has the possibility of defeating the free trail in the matter.

Chaudhary has been charged for murder and has also been booked for forgery for getting SIM cards on fake documents. He has also been charged for destroying evidence to escape punishment. In its arguments before the court the prosecution had held that they have filed a challan within the period of 90-days and were competent to carry out further investigation in the case. The prosecution had argued that it can file a supplementary challan in the case.

According to police officials after the filing of the challan,the investigation in the case are currently being looked into by a special investigation team (SIT) which is investigating the matter further and will bring to the notice of the court fresh evidence in the case. ” There are some reports pending with the FSL and there is also a hair sample of one of the accused pending and these things will be considered by the SIT before such an evidence is brought to the notice of the court,” said a police official.
