Chandigarh: Court orders attachment of railway property for not paying enhanced damages

KARNAIL SINGH alias Karnail Fauji started working in the fields at an early age, forced by the economic condition of his family. After retiring from the Army, he has been fighting for his land acquired by the Indian Railways — for a better compensation.

This week Karnail Singh, who along with eight persons of his village is fighting a case against the Railways, got some success when a local court ordered attachment of the property of local railway station after the department failed to release the amount of enhanced compensation to the nine farmers who had filed a case in 2003.

The next date of hearing is on July 8.

According to Karnail Singh, the land measuring around 1.5 acres belonging to nine farmers was acquired in 2002 by the Railways and they were given a compensation of Rs 5.52 lakh per acre. Not happy with the compensation, Karnail along with eight owners Jarnail Singh, Surmukh Singh, Gurmukh Singh, Jaswant Kaur, Charan Kaur, Sahib Singh, Baljinder Singh and Avtar Singh went to court in 2002.

Karnail, Surmukh, Jarnail and Gurmukh are brothers while Baljinder and Avtar are brothers too. All the nine persons have their ownership rights on the 1.5 acre land which was acquired by the Railways.

“In 2007, the court decided in our favour and ordered the Railways to give us an enhanced compensation of Rs 17 lakh per acre. But nine years have passed and they have not paid the money. Now we are happy that at last the court ordered attachment the railway property,” said Karnail.

He added that one of the petitioners, Jaswant Kaur, died during the pendency of the court case.
